Our Legal Take

Hotel guests have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided in the hotel and whether this tragedy may have been prevented.

  • What security measures, such as security patrols, guest screening and surveillance cameras, were in place to deter crime at the time of the shooting?
  • Have there been prior incidents of violence on or near property? If so, were any additional security precautions implemented by the hotel owner or management to protect guests?

Generally, property owners are required to protect all guests legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the hotel owner or management failed to provide adequate security to protect those on its premises, the families of Ms. Holland and Mr. Garvey may seek justice and elect to pursue legal claims for their wrongful deaths.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victims’ families retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.

Police and parents are seeking answers following a shooting outside Spice Lounge, which left four young teenagers hospitalized Saturday, December 17, 2016.

According to WSOC News 9, gunfire erupted “around 10:30 p.m. at the Spice Lounge on North Tryon Street, near Sugar Creek Road.” Responding officers apparently discovered four victims, ages 14 to 16, suffering from gunshot wounds in “the parking lot of the nightclub.”

A nearby restaurant manager estimates “a group of 100 kids” were outside prior to the shooting. He reportedly told WSOC, “this is not the first time the club has had problems.”

Our Legal Take

Nightclub and parking lot patrons have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided in the nightclub parking lot and whether this shooting may have been prevented.

  • What security measures, such as weapons screenings, security patrols, bright lighting, and surveillance cameras, were in place to deter crime at the time of the shooting?
  • What age restrictions were in place at the time of the shooting? How were any such restrictions enforced? Were any additional security precautions implemented by the property owner or management to protect minor patrons?

Generally, property owners are required to protect all patrons legally on the premises from any foreseeable harm. This responsibility is paramount when overseeing the wellbeing of minor children. Should the facts of this matter reveal that the nightclub parking lot owner or management failed to provide adequate security to protect those on its premises, the young victims and their families may seek justice and elect to pursue legal claims for their injuries.
