Negligent Security? Our Legal Take: 2 Shot, Killed in Fatal Fort Worth Apartment Home Invasion

Did negligent security contribute to this fatal apartment home invasion? Read Our Legal Take to find out if the victims’ families may have a legal avenue for justice and claims for compensation.

Local News

Two victims were reportedly shot and killed during an apartment home invasion at the Crest Oasis apartment complex in Fort Worth Saturday morning, October 29, 2016.

According to The Star-Telegram, the shooting occurred “around 4 a.m. at Crest Oasis Apartments at the 4700 block of American Boulevard.” One victim was discovered with fatal injuries at the scene. A second victim was transported to the hospital, where he later succumbed to injuries.

Police believe the “incident began as a home invasion,” per The Star-Telegram reports.

Our Legal Take

Apartment residents and guests have a right to feel safe and secure within the community. The Murray Law Firm questions the level of security provided at the apartment complex and whether this tragic loss of life may have been prevented.

  • How did the intruder(s) gain entry to the property? What security measures, such as gated-entry, fencing, security patrols, and surveillance cameras, were in place to deter crime at the time of the shooting?
  • Have there been prior incidents of violence on or near property and, if so, were any additional security precautions implemented by the property owner or management to protect residents?

Generally, property owners are required to protect all residents and guests legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the apartment complex owner or management company failed to provide adequate security to protect those on its premises, the families of the two victims may seek justice and elect to pursue a legal claim for their wrongful deaths.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victims’ families retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.

Security Lapse? Our Legal Take: 1 Shot, Injured in Memphis Hotel Robbery

Did negligent security contribute to the third reported shooting at the same hotel in less than a year? Read Our Legal Take to find out if the victim may have a legal avenue for justice and claims for compensation

Local News

A 37-year-old man reportedly suffered critical injuries during a robbery-shooting inside the Governor’s Inn hotel Monday, October 31, 2016.

WREG News reports, “[f]or the second time in just over a month, Memphis Police were back at the Governor’s Inn on Mt. Moriah to investigate a shooting inside the hotel.” The victim was apparently “getting off the elevator on the second floor when he was approached by a man in a black mask who demanded money and then shot him.”

The hotel was the subject of prior shooting investigations in September and May, per WREG reports.  Per the news outlet, “[i]n September, a man was shot during a robbery at the hotel…[i]n May, a woman was also shot here.” A hotel “clerk” allegedly told WREG, “the hotel needs more cameras and locks on all the outer doors.”

Our Legal Take

Hotel guests have a right to feel safe and secure on the property that they are visiting. The Murray Law Firm questions the level of security provided at the hotel and whether this shooting may have been prevented.

  • What security measures, such as guest screening, ID-controlled entry, security patrols, and surveillance cameras, were in place to protect guests at the time of the shooting?
  • Was the hotel management aware of prior incidents of violence, as reported by WREG, and, if so, were any additional security measures implemented to protect patrons and deter crime?

Generally, property owners are required to protect all guests legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the hotel owner or manager failed to provide adequate security to protect those on its premises, the victim may seek justice and elect to pursue a legal claim for his injuries.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
