Gunfire erupted early Sunday morning, August 11, 2019 outside an Austin, Texas bar leaving one man dead and two others injured.

According to KVUE.com, “[a]t 1:50 a.m. on Sunday, APD received a shots fired call…[a] Bar parking lot on Lamar Boulevard at Masterson Pass, just north of Rundberg Lane.”

When officers arrived they found three men with gunshot wounds.

KXAN.com is reporting that an argument “may have started over a girl or alcohol…and it quickly escalated into a physical fight.”

The group was kicked out of the bar when they began throwing chairs and tables.

According to the report, “The fight continued in the parking lot and a security guard came out and shot pepper spray at the brawling groups until they dispersed.”

As the three victims were leaving in their car, a truck pulled up and blocked the victims car and began shooting at the victims, hitting the victims.

As reported by KXAN.com, “Julio Cesar Gamez-Contreras was pronounced dead at the scene after medical personnel tried to revive him with CPR and other life-saving measures.”

The other two men were taken to Dell Seton Medical Center at the University of Texas with non life-threatening injuries.

The investigation is ongoing.

Bar and restaurant patrons have a right to feel safe and secure while on the premises they are visiting. The level of security provided at the property is of significance, and is a relevant consideration when analyzing whether this shooting may have been prevented.  The following questions are also important in assessing whether this incident may have been avoided:

  • Have there been prior incidents of violence on or near the property?
  • What security measures were in place to deter crime and protect the victims at the time of the shooting?
  • Was the restaurant aware of any suspicious activity on property prior to the shooting?
  • Did the bar notify authorities after the argument esculated?

Property owners are generally required to protect against foreseeable harm to anyone and everyone legally on the premises.  Should the investigation into this incident reveal facts that establish that the property owner or management lacked adequate security to protect its visitors, Julio Cesar Gamez-Contrera’s family may seek justice and elect to pursue legal claims and substantial compensation for their loss.  In addition, any injured victims may seek justice and elect to pursue legal claims and substantial compensation for their injuries.
