Security Lapse? Our Legal Take: Father Killed in Reported Promenade Champions Forest Apartment Home Invasion

A 26-year-old young man was reportedly shot and killed during a robbery home invasion at “an apartment at the Promenade Champions Forest Apartment Homes,” Wednesday night, December 30, 2015.

According to KHOU News, “three male suspects forced their way into a third floor apartment, where [the victim], 26, and his girlfriend were inside.”

Police apparently told media, “the three men broke in and demanded cash…after they didn’t get any cash, they ransacked the apartment, shot the victim and took his car keys.” The young father of two, who was a recent barber school graduate, had apparently only moved into the complex a few months prior.

Residents and guests of apartment complexes have a right to feel safe and secure within the community. The Murray Law Firm questions the level of security provided at the Promenade Champions Forest apartment complex, and whether this tragedy may have been prevented.

  • How did the assailants gain entry to the property? What security measures and access-controls, such as bright lighting, gated-entry, surveillance cameras, and security patrols, were in place at the time of the shooting?
  • Have there been previous reports of violence on or near property and, if so, were any additional security precautions implemented by the apartment complex owner or management to deter such crime?

Generally, property owners are required to protect all residents legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the apartment complex owner or management company failed to provide adequate security to protect those on its premises, the family of the young victim may seek justice and elect to pursue a legal claim for his wrongful death.
