Motel Security Breach? Our Legal Take: Woman Reportedly Assaulted at America’s Best Value Inn, Tuscaloosa

Police are reportedly searching for the assailant who sexually assaulted a 30-year-old Georgia woman at the America’s Best Value Inn on McFarland Boulevard Saturday, January 2, 2016.

According to AL News, the woman “woke up to find a man sexually assaulting her in her hotel room.” Per media reports, the attacker fled the scene and the victim was able to call police for help.  The assailant had apparently posed as a motel security guard and offered to assist the victim back to her room. The victim then went to sleep and awoke a few hours later to the same man assaulting her. Per AL News reports, “The motel said they do not have a security guard.”

Hotel and motel guests have a right to be safe and secure while on the premises of the establishment that they are visiting, and The Murray Law Firm questions whether this assault may have been prevented.

  • How did the assailant gain entry to the property and access to the guest? What access-controls and security measures, such as bright lighting, surveillance cameras, and security patrols, were in place to protect guests and deter crime?
  • Have there been previous incidents of crime on or near property and, if so, were any additional security precautions implemented by the motel owner or management?

Generally, motel owners are required to protect all guests legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the motel failed to provide adequate security to protect those on its premises, the victim may elect to seek justice and pursue a legal claim for her injuries and suffering.
