Memphis Police are reportedly searching for a possible serial rapist who may be responsible for the sexual assault of a woman at the Madison at Cypress Lake Apartments on April 10, 2016.

According to WMC News 5, “a woman told police a man broke into her apartment in the Madison at Cypress Lake Apartments and sexually assaulted her” at gunpoint sometime around 4:00 am.

“Investigators believe the man may be responsible for a string of sexual assaults at several Memphis apartment complexes,” WMC News reports. “On January 3, around 10:30 p.m., a woman told police a man broke into her apartment in the Arbors of Hickory Ridge Apartments. The man threatened her with a gun before robbing and sexually assaulting her.”

Police are allegedly investigating a potential connection between ten Memphis apartment crimes, which occurred between September 2014 and April 2016.

Our Legal Take

Apartment residents and guests have a right to feel safe and secure within the community. Given the rash of apartment crime plaguing the Memphis community, The Murray Law Firm questions the level of security provided at the subject apartment complex and whether this unconscionable attack may have been prevented.

  • How did the suspect gain entry to the property and apartment? What security measures, such as gated entry, bright lighting, security patrols, surveillance cameras, deadbolts, and alarms, were in place at the time of the assault?
  • Following the recent history of Memphis apartment assaults, were any additional security precautions implemented by the property owner to deter crime and protect residents?

Generally, property owners are required to protect all residents and guests legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the complex owner or management company failed to provide adequate security to protect those on its premises, the victim may seek justice and elect to pursue a legal claim for her injuries and suffering.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
