Security Lapse? Our Legal Take: Grandfather Killed in Houston Apartment Robbery-Shooting

A 53-year-old man was tragically shot and killed in front of his wife and grandson outside his southwest Houston apartment Friday morning, November 6, 2015.

According to KHOU News, “the victim had just pulled into his parking spot when a man ran up and demanded cash. The victim reached for his wallet, and that’s when the suspect opened fire and fatally shot him.” Police believe the victim may have been targeted and followed after cashing a check on his way home to his apartment, per media reports. A neighbor’s surveillance camera apparently captured grainy footage of the suspect running toward the car. However, Houston police have not yet identified the suspect.

  • What parking lot security measures, such as bright lighting, gated-entry, fencing, surveillance cameras, and security patrols, were in place at the time of the shooting to protect residents?
  • Have there been previous incidents of crime on or near property and, if so, were any additional security precautions implemented by the apartment owner and management to deter future violence?

Generally, apartment owners are required to protect all residents and guests legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the apartment complex owner or management company failed to provide adequate security to protect those on its premises, the victim’s family may seek justice and elect to pursue a legal claim for his wrongful death.
