Local News

47-year-old Benjamin Alvin Frazier was reportedly shot and killed outside the Discount Food Mart in Jacksonville Saturday night, June 25, 2016.

According to The Florida Times-Union, Mr. Frazier “was found shot to death about 9:30 p.m. in the parking lot of Discount Food Mart, 5609 Moncrief Road, on the Northside….”

“The owners heard at least one gunshot,” Sgt. Michael Paul told media. “Everybody went outside to see what that was and (the) victim was lying in the parking lot,” News 4 JAX reports.

Police have not yet identified a suspect or motive in the shooting.

“People who live along Moncrief Road know the area has more than its share of violence,” News 4 JAX reported following 4 shootings in 2014. Sadly, it appears the violence has continued. According to an ActionNewsJax.com report, local leaders named Moncrief Road “one of Jacksonville’s deadliest streets” in August 2015.

Our Legal Take

Store and parking lot patrons have a right to feel safe and secure on the property that they are visiting. The Murray Law Firm questions the level of security provided in the parking lot and whether this shooting may have been prevented.

  • What security measures, such as security patrols, bright lighting and surveillance cameras, were in place to protect patrons at the time of the shooting?
  • Was the store or parking lot owner aware of any prior incidents of violence on or near the property?  If so, were additional security precautions implemented by the property owner or management to deter crime?

Generally, property owners are required to protect all patrons legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the restaurant or parking lot owner or management failed to provide adequate security to protect those on its premises, the family of Benjamin Frazier may seek justice and elect to pursue a legal claim for his wrongful death.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim’s family retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
