Negligent Security? Our Legal Take: Man Shot, Robbed Outside Houston Apartment

Did negligent security contribute to this shooting? Read Our Legal Take to find out if the victim may have a claim for compensation.

Local News

A man was reportedly shot and robbed outside the La Fayette Village Apartments Friday evening, May 20, 2016.

According to Click2Houston News, a “thief jumped the victim about 10 p.m. as he walked home in the La Fayette Village Apartments.” The armed assailant apparently took the victim’s wallet and belongings before opening fire and fleeing the scene. The victim was transported to Memorial Hermann Hospital with serious injuries. His current condition has not been released.

Police have not yet identified a gunman, presumably leaving apartment residents concerned for their safety.

Our Legal Take

Apartment residents and guests have a right to feel safe and secure within the community. The Murray Law Firm questions the level of security provided at the apartment complex and whether this unconscionable attack may have been prevented.

  • How did the assailant gain entry to the property? What security measures, such as gated entry, bright lighting, security patrols, and surveillance cameras, were in place to protect residents at the time of the shooting?
  • Have there been prior incidents of violence on or near property and, if so, were any additional security precautions implemented by the property owner to deter crime?

Generally, property owners are required to protect all residents and guests legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the apartment complex owner or management company failed to provide adequate security to protect those on its premises, the victim may seek justice and elect to pursue a legal claim for his injuries.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.

HPD Blue Star Program: Police and Apartment Owners Work Together for a Safer Community

Although apartment owners cannot guarantee a crime-free community, they can deter crime and improve resident safety by implementing staff training programs and property safety measures.

Houston’s Blue Star Multi-Housing Program is a collaborative effort between local law enforcement and apartment owners to reduce crime and improve quality of life for residents within Blue Star communities.

Blue Star certification requires apartment owners and managers to complete an eight-hour training course and to meet all CPTED (Crime Preventions Through Environmental Design) standards. The crime prevention training and CPTED survey cover a variety safety issues, such as, lighting, perimeter fencing, landscaping, on-site security, and tenant screening.
