Our Legal Take

Apartment residents and guests have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided on the property and whether this shooting may have been prevented.

  • What security measures, such as bright lighting, surveillance cameras, off-duty police, and security patrols, were in place to deter crime and protect residents at the time of the shooting?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the apartment complex owner or management failed to provide adequate security to protect those on its premises, the victim may seek justice and elect to pursue legal claims for his injuries.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.

Parking Lot Security Lapse? Our Legal Take: Birmingham Apartment Shooting, Robbery

Did negligent security contribute to this apartment parking lot shooting? Read Our Legal Take to find out if the victim may have a claim for compensation.

Local News

A Birmingham man was reportedly shot and injured during a robbery at the Springville Landing Apartments Tuesday night, May 10, 2016.

AL News reports, the shooting occurred “in the parking lot of Springville Landing Apartments on Huffman Road. Birmingham police said a man approached the victim in the parking lot and asked for money.”

The assailant apparently opened fire during the course of the robbery, striking the victim in the shoulder before fleeing the scene. The victim’s current condition has not been released.

Police are still searching for the gunman, presumably leaving residents once again concerned for their safety. News reports suggest the property was tied to gun-related violence occurring in August 2015 and November 2015.

Our Legal Take

Apartment residents and guests have a right to feel safe and secure within the community. Given the alleged history of violence associated with the property, The Murray Law Firm questions the level of security provided at the apartment complex and whether this unconscionable attack may have been prevented.

  • How did the assailant gain entry to the property? What security measures, such as gated entry, bright lighting, security patrols, and surveillance cameras, were in place to protect residents at the time of the shooting?
  • Were any additional security precautions implemented by the property owner to deter crime, following recent reports of gun-related activity?

Generally, property owners are required to protect all residents and guests legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the apartment complex owner or management company failed to provide adequate security to protect those on its premises, the victim may seek justice and elect to pursue a legal claim for his injuries.

Fatal Security Lapse? Our Legal Take: Mother-To-Be Killed in Panorama East Apartment Shooting

Local News

A 16-year-old mother-to-be was reportedly shot and killed during a robbery “at Panorama East Apartments” in Birmingham Friday morning, January 8, 2016.

According to AL News, the young victim  “along with her boyfriend were sitting in their car eating pizza when an unknown black male approached them and demanded money. [She] was shot in the course of the robbery.”

Birmingham Police have not yet identified the gunman and Chief A.C. Roper is reportedly asking for the “community’s help in putting this cold blooded killer behind bars.”

Our Legal Take

Residents and guests of apartments have a right to feel safe and secure within the community. The Murray Law Firm questions the level of security provided to residents and guests of the Panorama East apartment complex, and whether this tragedy may have been prevented.

  • How did the gunman gain entry to the property? What parking lot security measures, such as bright lighting, gated-entry, fencing, surveillance cameras, and security patrols, were in place at the time of the shooting?
  • Have there been previous incidents of violence on or near property and, if so, were any additional security precautions implemented by the apartment complex owner and management to deter crime?

Generally, property owners are required to protect all residents and guests legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the apartment complex owner or management company failed to provide adequate security to protect those on its premises, the family of the young victim and her unborn child may seek justice and elect to pursue a legal claim for their wrongful deaths.

Given the complexities of pursuing a negligent security case, it is imperative that the victim’s family retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.  Based upon its prior experience in handling apartment security negligence claims, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed.

Choosing the Right Attorney

Selecting the right attorney for you or your family is highly important. You must feel confident that the attorney you hire has a complete understanding of the law applicable to your particular case, and has successful experience in handling such cases.

Important: Do not hire a lawyer who has violated the Rules of Professional Conduct!!!

You should not hire an attorney who calls you or visits you unsolicited, or anyone that contacts you directly to offer legal services. This activity is strictly prohibited by Rule 7.3 of the American Bar Association (ABA) Model Rules of Professional Conduct, which states as follows:

ABA Center for Professional ResponsibilityA LAWYER “SHALL NOT” CONTACT A PROSPECTIVE CLIENT THROUGH A “LIVE TELEPHONE” OR AN “IN-PERSON” VISIT.

– RULE 7.3, ABA MODEL RULES OF PROFESSIONAL CONDUCT.

If an attorney, or someone acting on behalf of an attorney, contacts you in this manner, that attorney is in violation of this Rule. This unethical and unprofessional activity on the part of the lawyer is good sign that you should stay away. It is imperative that you are represented by an attorney who is capable of advocating for you within the confines of the law, and an attorney who fails to abide by the Rules of Professional Conduct is probably not the best fit. In fact, any such attorney should be immediately reported to the local State Bar Association. If you have been contacted in such an unsolicited manner, contact us and we’ll assist you in filing a report.

Contingency Fees Disclaimer: “Contingent attorneys’ fees refers only to those fees charged by attorneys for their legal services. Such fees are not permitted in all types of cases. Court costs and other additional expenses of legal action usually must be paid by the client.
