Negligent Security? Our Legal Take: 2 Injured in Waco Restaurant Shooting

Did negligent security contribute to this restaurant shooting? Read Our Legal Take to find out if the victims may have a legal avenue for justice and a claim for compensation.

Local News

51-year-old Michael Keith Perry and 25-year-old Joshua James Moore were reportedly shot and injured during a party at TJ’s Wine, Dine and Soul Food Supper Club restaurant Saturday, July 23, 2016.

According to KWTX News, “[o]fficers were sent at about 1:30 a.m. Saturday to TJ’s Wine, Dine and Soul Food, in the 900 block of East Johnson Street, in Waco, after reports indicated a party had gotten out of control and gunshots had been fired.”

“As the club was being cleared out, a fight broke out both inside and outside the club,” MyCenTX.com reports.

Mr. Perry and Mr. Moore were reportedly transported from the scene to Baylor Scott & White Hillcrest Medical Center with injuries. Police have apparently not yet identified a suspect or motive in the shooting.

Our Legal Take

Restaurant and nightclub patrons have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided to those at the restaurant and whether this shooting may have been prevented.

  • What security measures, such as weapons screenings, surveillance cameras, and security guards, were in place to protect patrons at the time of the shooting?
  • Were efforts made to deescalate any initial altercation and safely and separately remove those who may have been involved from the premises prior to the shooting? Were police called to assist with crowd control?

Generally, property owners are required to protect all patrons legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the nightclub owner or management failed to provide adequate security to protect those on its premises, Mr. Perry and Mr. Moore may seek justice and elect to pursue a legal claim for their injuries.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victims retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
