A parking lot shooting in Fayetteville reportedly claimed the life of 20-year-old Diquane McLamb Wednesday, July 27, 2016.

According to ABC 11 News, “officers were called to the area near 816 S. Reilly Road after receiving a call about shots being fired. When they arrived, they found a driver who had been shot inside a vehicle that was in the parking lot of Discount Tobacco.”  The victim, identified by ABC 11 as Mr. McLamb, was transported to Cape Fear Valley Medical Center. Per the news outlet, “[a]uthorities said an unknown suspect walked up to the vehicle and shot [Mr. McLamb] while he sat inside of the car. Two other people who were also inside the vehicle were not injured.”

Our Legal Take

Parking lot and shopping center patrons have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided to those in the parking lot and whether this tragedy may have been prevented.

  • What security measures, such as bright lighting, surveillance cameras and security patrols, were in place to protect patrons at the time of the shooting?
  • Was the owner or management aware of any reports of prior criminal activity on or near property and, if so, were any additional security precautions implemented to deter future crime?

Generally, property owners are required to protect all patrons legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the parking lot owner or management failed to provide adequate security to protect those on its premises, the family of Diquane McLamb may seek justice and elect to pursue a legal claim for his wrongful death.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim’s family retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
