Houston News

23-year-old Taylor Phillips, a Houston Mother, was struck and killed by an allegedly impaired driver, according to ABC 13. Ms. Phillips’ mother, Carmen Rainer, and her 1-year-old son survived the accident.

According to FOX 5, “surveillance footage obtained from the bar in south Houston” where the individual was drinking reveals the impaired 19-year-old driver “had apparently been drinking for 6 hours before getting behind the wheel.” Police told media the business “surveillance shows he may have had 12 beverages in total including 3 shots of tequila.”

“Five bar employees who served [the driver] at [the location] were arrested and charged Wednesday for serving alcohol to a minor,” ABC 13 reports.

Our Legal Take

As the details of this tragedy continue to develop, and if the driver is found to be at fault, the family of Taylor Phillips may elect to file civil claims in her wrongful death. Additionally, the family may also pursue claims against the business owners, should they be found to have violated the law. Under Dram Shop laws, vendors selling alcohol may be held liable for an injury or death caused by an individual to whom alcohol was sold if the individual was (1) obviously intoxicated to a point that the individual was a clear danger to the safety of others; and, (2) the intoxication was the proximate cause of the inner or death.

Based upon its experience and success handling motor vehicle accident and dram shop liability cases, The Murray Law Firm suggests that the Phillips family should retain an experienced personal injury firm to protect their interests and ensure an unbiased investigation. Photographs of the vehicles and roadways involved and a review of traffic and bar surveillance footage will need to be performed immediately before any evidence is damaged or destroyed.

Could this senseless Houston apartment shooting have been prevented and are justice and compensation available to the victim?

Local News

A 24-year-old man was shot and injured “by would-be robbers” at the “Chestnut Hill apartments near Bellerive Drive and Fondren Road” Friday, October 26, 2018, according to KPRC 2.

Police told CW39, a male resident was shot while confronting “a man breaking into his vehicle” in the apartment complex parking lot. The victim was transported “to Memorial Hermann Southwest with a single gunshot wound to the hip.” His identity and current condition have not been released.

Our Legal Take

Apartment residents and guests have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided on the property and whether this shooting may have been prevented.

  • Have there been prior incidents of violence on or near property? What security measures, such as gated-entry, bright lighting, fencing, surveillance cameras, and security patrols, were in place to deter crime and protect the victim at the time of the shooting?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the apartment complex owner or management failed to provide adequate security to protect those on its premises, the victim may seek justice and elect to pursue legal claims for his injuries.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.

Did a fatal security lapse contribute to the tragic death of this teenage girl?

Local News

Security measures are in question after a shooting at the San Lucas apartment complex in Houston claimed the life of 15-year-old Zuleyma Hernandez Sunday afternoon, April 15, 2018.

According to The Houston Chronicle, gunfire erupted “at the San Lucas Apartments at 6111 Glenmont,” shortly before 5:00 p.m. Tragically, Miss Hernandez succumbed to fatal injuries at the scene. A second victim was transported to the hospital with a gunshot wound to the leg.

KPRC 2 reports, “violent crime is not uncommon at the San Lucas Apartments.” The media investigation reveals Houston Police responded to “207 calls for service in the last year,” including the fatal shooting of a 15-year-old boy in February 2017. The unconscionable death of yet another child on property raises grave security concerns.
