Local News

52-year-old Osman Darcan was reportedly shot and killed during an attempted robbery outside an Internationl Drive hotel Thursday, September 8, 2016.

According to The Orlando Sentinel, the fatal shooting occurred at a hotel “off Sand Lake Road between I-Drive and Universal Boulevard.” Mr. Darcan and his wife were apparently exiting their vehicle when “a man with a gun approached [his] wife and tried to steal her purse.”  According to the news report, Mr. Darcan was killed protecting his new wife from [the] armed robber in the parking lot of…[the] hotel.” CBS News reports, “the robber…fled without the purse into a waiting car.”

Our Legal Take

Hotel guests have a right to feel safe and secure while on premises. The Murray Law Firm questions the level of security provided at the hotel and whether this tragedy may have been prevented.

  • How did the suspect gain access to the property? What hotel security measures, such as gated-entry, bright lighting, surveillance cameras, and security patrols, were in place to protect hotel guests at the time of the shooting?
  • Was the hotel owner or management aware of any prior incidents of violence on or near property?  If so, were additional security precautions implemented by the property owner to deter crime?

Generally, hotel owners are required to protect all guests legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the hotel management failed to provide adequate security to protect those on its premises, the family of Osman Darcan may seek justice and elect to pursue a legal claim for his wrongful death.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim’s family retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
