Fatal Security Lapse? Our Legal Take: Father Killed in Raleigh Shopping Center Shooting

Did negligent security contribute to the death of this young father? Read Our Legal Take to find out if the victim’s family may have a legal avenue for justice and claims for compensation.

Local News

The Raleigh community is seeking an end to violence after Rahim Cummings, a 31-year-old father of two, was reportedly shot and killed outside a shopping center Friday afternoon, August 12, 2o16.

According to WNCN News, “[Mr.] Cummings was shot in a shopping center parking lot in the 4600 block of Capital Boulevard around 5 p.m. Friday.” Police have allegedly since made two arrests in connection with the fatal shooting.

Family and friends are now celebrating the life of this young father as they mourn his passing. During a vigil, Canei Cummings “described [her husband] as a family man and called for an end to violence,” WNCN reports.

Media reports indicate a Capital Boulevard shopping center was the subject of another fatal shooting investigation in September 2015.

Our Legal Take

Parking lot and shopping center patrons have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided to those in the parking lot and whether this attack may have been prevented.

  • What security measures, such as surveillance cameras and security patrols, were in place to protect patrons at the time of the shooting?
  • Was the owner or management aware of any reports of prior criminal activity on or near property and, if so, were any additional security precautions implemented to deter future crime?

Generally, property owners are required to protect all patrons legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the parking lot owner or management failed to provide adequate security to protect those on its premises, the family of Rahim Cummings may seek justice and elect to pursue a legal claim for his wrongful death.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim’s family retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
