Did a security failure contribute to this senseless loss of life?

Gunfire erupted outside a San Antonio motel Friday morning, April 20, 2018, claiming the life of 33-year-old Robert Serna.

According to KSAT 12, the shooting occurred “toward the back parking lot of Motel 6, near Interstate 37 and Hot Wells.”  Mr. Serna was shot multiple times during what appears to have been an “ambush,” per MySanAntonio reports. The media report indicates a female suspect approached Mr. Serna while two “hiding suspects…were waiting to attack.”

Our Legal Take

Hotel guests have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided on the property and whether this tragedy may have been prevented.

  • Media reports indicate the suspects were “hiding” prior to the fatal parking lot “ambush.” What parking lot security measures, such as fencing, surveillance cameras, bright lighting, and security patrols, were in place to deter crime and protect guests at the time of the shooting?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the hotel owner or management failed to provide adequate security to protect those on its premises, the family of Robert Serna may seek justice and elect to pursue legal claims for his wrongful death.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim’s family retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
