Did a Fatal Security Lapse Contribute to the Death of This Young Father?

Local News

33-year-old Trevis Stephens was reportedly shot and killed during a shooting at Lounge 2.28 Bar and Grille Sunday, January 1, 2017.

According to Cleveland.com, the fatal shooting occurred “early Sunday at Lounge 2.28 Bar & Grille on Northfield Road.” Police allegedly told media, “a bouncer kicked the shooter out of the bar after an altercation.” The shooter apparently then returned with “a gun from his car and fired shots into the bar,” fatally striking Mr. Stephens. “Investigators do not believe [Mr.] Stephens was involved in the altercation that preceded the shooting,” Bedford Detective Sgt. Rick Suts told media.

Family members told media they will remember Mr. Stephens as “a devoted father who was always willing to help his relatives and friends.”

Our Legal Take

Business patrons have a right to feel safe and secure while on the premises that they are visiting. The Murray Law Firm questions the level of security provided in the parking lot outside the bar and whether this tragedy may have been prevented.

  • What security measures, such as bright lighting, security patrols and surveillance cameras, were in place to deter crime at the time of the shooting?
  • Were any efforts made to notify authorities after the initial alteration?

Generally, property owners are required to protect all patrons legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the owner or management of the parking lot failed to provide adequate security to protect those on its premises, the family of Mr. Stephens may seek justice and elect to pursue legal claims for his wrongful death.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim’s family retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
