Could the shooting at a Destin nightclub have been prevented and are justice and compensation available to Mr. Thomas and Mr. Phillips?

Local News

Gunfire rang out at a Destin, Florida nightclub early Sunday morning, March 10, 2019, leaving two men injured.  According to WJHG.com, “[s]heriff’s officials…were called to Bric à Brac, a restaurant and nightclub in Destin, around 4:18 a.m.” The news story reports “a disturbance around closing time led to multiple shots being fired and people fleeing.”  WKRG.com is reporting, “Trevor Thomas of Crestview and Raheem Phillips of DeFuniak Springs were taken to Fort Walton Beach Medical Center for treatment after suffering apparent non-life-threatening gunshot wounds.”

Media reports indicate a person of interest has been detained for questioning as the investigation continues.

Our Legal Take

Nightclub patrons have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided on the property and whether this tragedy may have been prevented.

  • Have prior incidents of violence been reported on or near the property?
  • Does the nightclub have a protocol to check guests for deadly weapons prior to entering the establishment?
  • What nightclub security measures, such as bright lighting, visible surveillance cameras, and security personnel, were in place to deter crime and protect Mr. Thomas and Mr. Phillips at the time of the shooting?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the property owners failed to provide adequate security to protect those on the premises, Mr. Thomas and Mr. Phillips may seek justice and elect to pursue legal claims for their injuries.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that Mr. Thomas and Mr. Phillips retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
