Did negligent security contribute to this tragic loss of Michael Christopher Clark and are justice and compensation available to the victim’s  family?

According to CDApress.com, “Kootenai County Sheriff’s deputies responded to a reported shooting around 1:40 and found the victim…lying in the parking lot at Hayden Creek Plaza, outside [a local] Bar.”  KHQ.com is reporting, “two men got into an altercation earlier in the bar then went outside where the suspect…shot the victim.”  The news report states “another person in the bar retrieved the gun and detained [the suspect] until police arrived on scene.”  In a subsequent news report, KHQ.com identified the victim as “Michael “Topher” Christopher Clark.”

OUR LEGAL TAKE

Bar patrons have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided in the bar parking lot and whether this tragedy may have been prevented.

  • Have there been prior incidents of violence on or near property?
  • Were authorities called before the argument escalated to a shooting?
  • What security measures, such as bright parking lot lighting, surveillance cameras, and security patrols, were in place to deter crime and protect Mr. Clark at the time of the shooting?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the bar or parking lot owners failed to provide adequate security to protect those on its premises, Ms. Clark’s family may seek justice and elect to pursue legal claims for their loss.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that Ms. Clark’s family retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
