Could the tragic loss of this heroic young father have been prevented and is justice available to his family?

Local News

Security measures are in question after a south Omaha restaurant shooting claimed the life of 23-year-old Franco Gonzalez-Mendez and left his brother, Edgar Gonzalez-Mendez, injured Sunday night, July 15, 2018.

The two brothers were apparently shot while “trying to defend their friend” in an altercation outside “Guaca Maya” restaurant, according to the Omaha World-Herald. Tragically, Franco Gonzalez-Mendez succumbed to fatal injuries. He leaves behind a 4-year-old daughter. Edgar Gonzalez-Mendez suffered a gunshot wound to the right cheek. His current condition has not been released.

The restaurant was reportedly the location of a stabbing investigation in March and a shooting eight years ago, per Kearney Hub reports.  The news story states that an individual was “stabbed in a late-night carjacking outside Guaca Maya.”

Did negligent security contribute to this Omaha shooting? We represent individuals and families who have suffered a tragic loss or injury as a consequence of negligent property security. Our Legal Take

Restaurant and nightclub patrons have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided on the property and whether this tragedy may have been prevented.

  • What additional security measures, such as weapons screenings, bright parking lot lighting, surveillance cameras, and off-duty police patrols, were implemented by the restaurant owner following media reports of prior violence on property?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the property or business owner failed to provide adequate security to protect those on its premises, the family of Franco Gonzalez-Mendez may seek justice and elect to pursue legal claims for their loss. Additionally, Edgar Gonzalez-Mendez may also elect to pursue legal claims for his injuries.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victims retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.

Our Legal Take

Hotel patrons have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided on the property and whether this tragedy may have been prevented.

  • Have there been prior incidents of violence on or near property?
  • What hotel security measures, such as bright parking lot lighting, surveillance cameras and off-duty police patrols, were in place to deter crime and protect the young victim at the time of the shooting?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the hotel owner failed to provide adequate security to protect those on its premises, the victim’s family may seek justice and elect to pursue legal claims for their loss.
