How did a gunman gain access to the property? What security measures, such as gated-entry, bright lighting, security patrols and surveillance cameras, were in place to deter crime at the time of the shooting?

  • Crime reports, from Spotcrime.com, reveal a number of recent assaults and robberies in the surrounding area. Have there been prior incidents of violence on property and, if so, were any additional security precautions implemented by the property owner or management to protect residents?

Generally, property owners are required to protect all residents and guests legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the apartment complex owner or management company failed to provide adequate security to protect those on its premises, the victim’s family may seek justice and elect to pursue a legal claim for his wrongful death.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim’s family retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.

Fatal Security Lapse? Our Legal Take: 1 Killed, 1 Injured in Houston Bar Parking Lot Shooting

Did negligent security contribute to the death of one man and the injury of another? Read Our Legal Take to find out if the victims and their families may have a legal avenue for justice and claims for compensation.

Local News

A parking lot shooting outside the Sol Billares Y Deportes bar in Houston reportedly claimed the life of one man and left another injured Monday morning, September 5, 2016.

According to News 2, “[t]he shooting was reported about 6 a.m. at the Sol Billares Y Deportes bar, at 5920 Bellaire Blvd.” Two 27-year-old men were reportedly shot “in the parking lot of the bar.”

Both men were transported to Memorial Hermann Southwest Hospital for emergency care, and police are apparently still searching for suspects and a motive.

Our Legal Take

Business and parking lot patrons have a right to feel safe and secure on the property they are visiting. The Murray Law Firm questions the level of security provided in the parking lot where the shooting occurred and whether this tragedy may have been prevented.

  • What security measures, such as weapons screenings, security patrols, bright lighting, and surveillance cameras, were in place to protect patrons at the time of the shooting?
  • Have there been prior incidents of violence on or near property? If so, were any additional security measures implemented by the bar owner to deter crime?

Generally, property owners are required to protect all patrons legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the parking lot owner or manager failed to provide adequate security to protect those on its premises, the victim’s family may seek justice and elect to pursue legal claims for his wrongful death. Additionally, the other victim of the shooting may pursue claims for his injuries.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victims retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.

Security Lapse? Our Legal Take: 1 Killed in Cindy’s Nightclub Shooting, Houston

Local News

An altercation outside Cindy’s Night Club in Houston reportedly ended in a fatal shooting early Thursday morning, April 7, 2016.

According to The Houston Chronicle, “gunfire erupted about 2:15am outside Cindy’s Night Club in the 11200 block of Hempstead….”

Several nightclub patrons were apparently standing in the parking lot after closing when a man approached the victim and the two got into an argument. The assailant then “pulled out a small-caliber handgun and shot the [victim],” The Houston Chronicle reports.

Police are still searching for the gunman.

Our Legal Take

Nightclub and parking lot patrons have a right to be safe and secure while on the premises of the establishment that they are visiting. The Murray Law Firm questions the level of security provided to patrons of the parking lot where this incident occurred and whether this tragedy may have been prevented.

  • What parking lot security measures, such as surveillance cameras, bright lighting and security patrols, were in place to protect patrons at the time of the shooting?
  • Have there been previous incidents of violence on or near property and, if so, were any additional security precautions implemented by the nightclub or parking lot owner to deter crime?

Generally, nightclub and parking lot owners are required to protect all patrons legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the owner or management of the parking lot or nightclub failed to provide adequate security to protect those on its premises, the family of the victim may elect to seek justice and pursue a legal claim for his wrongful death.

Given the complexities of pursuing a negligent security case, it is imperative that the victim’s family retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.  Based upon its prior experience in handling property security negligence claims, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed.

Choosing the Right Attorney

Selecting the right attorney for you or your family is highly important. You must feel confident that the attorney you hire has a complete understanding of the law applicable to your particular case, and has successful experience in handling such cases.

Important: Do not hire a lawyer who has violated the Rules of Professional Conduct!!!

You should not hire an attorney who calls you or visits you unsolicited, or anyone that contacts you directly to offer legal services. This activity is strictly prohibited by Rule 7.3 of the American Bar Association (ABA) Model Rules of Professional Conduct, which states as follows:

ABA Center for Professional ResponsibilityA LAWYER “SHALL NOT” CONTACT A PROSPECTIVE CLIENT THROUGH A “LIVE TELEPHONE” OR AN “IN-PERSON” VISIT.

– RULE 7.3, ABA MODEL RULES OF PROFESSIONAL CONDUCT.

If an attorney, or someone acting on behalf of an attorney, contacts you in this manner, that attorney is in violation of this Rule. This unethical and unprofessional activity on the part of the lawyer is good sign that you should stay away. It is imperative that you are represented by an attorney who is capable of advocating for you within the confines of the law, and an attorney who fails to abide by the Rules of Professional Conduct is probably not the best fit. In fact, any such attorney should be immediately reported to the local State Bar Association. If you have been contacted in such an unsolicited manner, contact us and we’ll assist you in filing a report.

Contingency Fees Disclaimer: “Contingent attorneys’ fees refers only to those fees charged by attorneys for their legal services. Such fees are not permitted in all types of cases. Court costs and other additional expenses of legal action usually must be paid by the client.
